These Terms of Use govern the use of the VeloGrid platform and the booking and use of bicycle parking facilities accessible through the VeloGrid platform.
VeloGrid AG, Weiherweg 8a, 8604 Volketswil, Switzerland ("VeloGrid"), operates the digital VeloGrid platform and, on behalf of the respective facility operators, performs tasks relating to digital processing, operational organisation, coordination and quality assurance for the connected facilities.
The specific bicycle parking facility is offered by the facility operator named in the facility details. The contract for the use of the respective facility is concluded between the user and that facility operator.
VeloGrid provides in particular the booking and access functions, payment processing and other digital functions required for use, and may engage service partners to provide individual services.
By registering for, or using, the VeloGrid platform, the user agrees to these Terms of Use.
Facility: Bicycle parking infrastructure accessible through the VeloGrid platform, regardless of its technical or structural design.
Facility operator / Operator: The natural or legal person who offers the respective facility to users and is responsible for the usage relationship with the user. The respective operator is identified in the facility information.
VeloGrid: VeloGrid AG as the operator of the VeloGrid platform and as operational coordinator of the connected facilities.
VeloGrid platform: The digital infrastructure operated by VeloGrid, in particular mobile applications, web applications, and the booking, access, payment and other related technical functions.
Service partner: Third-party companies engaged by VeloGrid or the respective operator to provide individual operational services such as customer support, technical assistance, diagnostics, maintenance, cleaning or on-site interventions.
Parking space / Box: A bookable or assigned parking or storage space within a facility for a bicycle and, where provided for, further items.
Booking: The reservation or use of a parking space made through the VeloGrid platform in accordance with the conditions applicable to the respective facility.
Bicycle: A bicycle with or without electric drive and, where the respective facility is approved for it, comparable two-wheelers or other vehicles expressly permitted in the facility details.
Items: Objects that the user deposits together with the bicycle in a parking space provided for that purpose.
User: A natural person who uses the VeloGrid platform or a facility accessible through it.
User account: The personal user profile within the VeloGrid platform.
Payment service provider: An external service provider engaged to process payment transactions.
The contract for the use of a specific facility or parking space is concluded between the user and the respective operator.
VeloGrid does not thereby become a party to the usage relationship between the operator and the user.
VeloGrid provides the technical platform and, on behalf of the operator, performs in particular tasks in connection with:
VeloGrid may engage service partners for individual services. Within the scope of their respective task, service partners may communicate directly with the user or carry out technical or operational measures.
The operator remains responsible for the facility for which it is designated as operator in the facility details.
The opening of a user account is required to use certain functions of the VeloGrid platform.
By registering, the user confirms that they are at least 18 years old or have the consent of their legal representative to use the platform.
The user is obliged to provide complete and accurate information required at registration and to keep it up to date.
VeloGrid may verify the contact details provided by the user, in particular the e-mail address or mobile phone number.
Certain functions may be restricted until a required verification has been completed.
The user is obliged to keep their access credentials confidential and to protect them from access by unauthorised third parties.
The user account may not be transferred to, or made available for independent use by, third parties.
If the user becomes aware of unauthorised access to their user account, or a corresponding suspicion, they must inform VeloGrid without delay.
Until such notification, bookings made through the user's account may be attributed to the user to the extent that the unauthorised access is due to a breach of the user's duty of care.
A booking begins with the corresponding confirmation of the booking start in the VeloGrid platform.
From that point on, the conditions displayed for the respective facility or the selected rate apply, regardless of the time at which the bicycle is actually placed in the facility.
The user must properly end a booking in accordance with the procedures displayed in the VeloGrid platform.
Where a parking space must be completely emptied, all bicycles and items must be removed before the booking is ended.
If the user is unable to properly end a booking due to a technical fault, they must contact support without delay. Support, or a responsible service partner, may review the process and technically end or correct the booking.
Where offered in the VeloGrid platform, a booking may be cancelled free of charge within the grace period stated there, provided the relevant parking space has not yet been used or opened.
The applicable grace period is displayed in the platform.
VeloGrid and the service partners engaged are entitled to review ongoing bookings for unusual or evidently improper use.
In doing so, the usual or expected duration and patterns of use for the respective facility may in particular be taken into account.
Where there is reason to believe that a booking was inadvertently not ended, or that the facility is not being used as intended, the user may be asked, via the contact details on file, to clarify the situation.
If no clarification is provided, or if there is a justified suspicion of misuse, VeloGrid or a service partner authorised for this purpose may end the ongoing booking.
Charges accrued up to the time of termination under the applicable rate remain owed.
Facilities offered through the VeloGrid platform are generally bookable and usable around the clock.
For individual facilities, the operator may set differing opening or usage hours. These are displayed in the facility details in the VeloGrid platform.
Temporary restrictions may arise in particular due to maintenance work, technical faults, security measures, official orders or operational requirements.
There is no entitlement to a parking space being available at all times.
Whether immediate use, a reservation, or another form of booking is possible follows from the functions and facility details of the respective facility.
The permitted maximum duration of use is governed by the conditions displayed for the respective facility or the selected rate.
Additional site- or facility-specific usage, safety, opening or pricing conditions may apply to individual facilities.
These are published in the facility details, within the VeloGrid platform or directly at the facility, and must be observed when using the relevant facility.
The user must comply with technical requirements, in particular regarding permitted dimensions, weight, positioning of the bicycle or special operating procedures.
The user must use the VeloGrid platform and the connected facilities properly, carefully and in accordance with the displayed operating and safety instructions.
In particular, the user is obliged to:
The user is responsible for properly closing the parking space after placing or removing the bicycle and for making sure that the door or access point is actually closed and locked.
This applies regardless of whether the locking process is triggered automatically, manually, or by an input in the VeloGrid platform.
If the user notices that a door or lock is not functioning properly, they may not leave the bicycle or the parking space unattended and must contact support without delay.
If the user leaves the facility without properly closing the parking space or checking that it has locked successfully, this is deemed improper use.
The following are in particular considered misuse or use in breach of contract:
Where there is justified suspicion of misuse, or a breach of these Terms of Use, VeloGrid or a service partner authorised for this purpose may end ongoing bookings or restrict access to individual facilities.
VeloGrid may temporarily suspend the user account.
In the case of serious or repeated breaches, VeloGrid may permanently exclude the user from further use of the VeloGrid platform.
Any payment or damage claims already accrued remain unaffected.
The prices, rates and, where applicable, subscription conditions applicable to a facility are shown to the user in the VeloGrid platform before the respective booking or subscription is concluded.
The displayed prices include applicable statutory taxes, where such taxes are due.
The fees owed for the use of a facility, including the taxes contained therein, belong to the respective operator.
VeloGrid is authorised by the operator to collect and process these amounts via the VeloGrid platform and the payment service providers engaged.
Upon successful payment to VeloGrid or the payment service provider engaged, the user fulfils their payment obligation towards the operator in the corresponding amount.
The tax declaration and remittance of taxes attributable to the usage service is the responsibility of the respective operator.
The available payment methods are displayed in the VeloGrid platform and may vary depending on country, facility or rate.
The user is responsible for having a valid payment method with sufficient funds or credit available.
Where technically provided for, payment methods may be stored for later use.
By using or storing a payment method, the user authorises VeloGrid and the payment service providers engaged to charge amounts due in accordance with the selected rate.
Depending on the payment method selected, VeloGrid AG or a payment service provider engaged by VeloGrid may appear as the payee or transaction descriptor on the account or card statement.
This does not change the fact that the usage service is provided by the respective operator and that the fee owed for it belongs to the operator.
If a payment due cannot be successfully executed, the claim remains outstanding.
VeloGrid may, on behalf of the operator, attempt to collect payment again or request that the user settle the outstanding amount.
Until outstanding claims are settled, VeloGrid may restrict the ability to make further bookings or temporarily suspend the user account.
Obvious booking errors, technical billing errors or otherwise incorrectly calculated amounts may be corrected or refunded by VeloGrid after review.
Any further-reaching claim to a waiver or refund exists only to the extent provided by law or arising from the conditions applicable to the relevant booking.
If the user initiates a chargeback of a legitimate payment despite the underlying claim existing, the corresponding amount remains owed.
VeloGrid may suspend the user account until the outstanding amount is clarified or settled.
Subscriptions or other recurring or time-limited rates may be offered for individual facilities.
Term, price, renewal, cancellation, scope of services and geographic scope are displayed before the respective offer is concluded.
A subscription does not establish an entitlement to a parking space being available at all times, unless expressly stated otherwise.
A first point of contact is generally available around the clock for user enquiries and fault reports.
Support may be provided by VeloGrid or by service partners engaged by VeloGrid.
The around-the-clock availability of the first point of contact does not constitute an assurance that all technical faults or on-site interventions can always be resolved or carried out immediately.
Further technical support or on-site interventions may depend on the availability hours of the responsible service partners.
In the event of a personal emergency, the relevant public emergency services must be contacted first.
If, after ending a booking, the user notices that items remain in a parking space, they must contact support without delay.
VeloGrid or a service partner may, to the extent technically and operationally possible, coordinate the recovery of the items.
There is no entitlement to immediate opening, delivery or free-of-charge release.
The storage, shipping, handover or disposal of found or left-behind items may be subject to the statutory and operational rules applicable to the respective facility.
VeloGrid is responsible for the proper provision and operation of the VeloGrid platform within the scope of the technically available and agreed functions.
Uninterrupted or error-free availability of the platform or individual facilities at all times is not guaranteed.
Within its area of responsibility, VeloGrid is responsible in particular for the proper performance of its own platform, organisational and coordination services.
The respective operator is responsible for the specific facility within its respective area of responsibility.
This may in particular include the physical infrastructure, site-related operating conditions, opening hours, and the local power and internet supply.
The precise division of tasks between the operator, VeloGrid and the service partners engaged may vary from facility to facility.
VeloGrid may engage service partners for support, maintenance, diagnostic and intervention services.
These service partners are responsible for the proper performance of the services they have undertaken.
To the extent that the selection, engagement or coordination of a service partner is carried out by VeloGrid, VeloGrid remains responsible for the careful performance of its own duties in this regard.
Restrictions or outages of individual facilities may arise in particular from disruptions to the power supply, internet connection, local infrastructure, maintenance work, external influences or other site-related circumstances.
To the extent that such circumstances lie outside VeloGrid's area of responsibility, VeloGrid gives no warranty as to the availability of the affected facility.
Use of a facility does not, unless expressly stated otherwise, constitute a bailment (custody) agreement.
Operators and VeloGrid do not undertake individual surveillance or custody of parked bicycles or other items.
For theft, loss or damage caused by third parties, operators and VeloGrid are liable only to the extent of statutorily mandatory liability.
This applies in particular where the user has not properly closed the parking space, or has not checked that it locked successfully, contrary to Section 7.1.
The user is liable for damage caused intentionally or negligently through use of the VeloGrid platform or a facility that breaches the contract, is improper, or otherwise breaches an obligation.
To the extent permitted by law, liability for indirect damage and consequential damage is excluded.
Mandatory statutory liability provisions remain reserved in all cases.
The user may terminate their user account at any time via the function provided for this purpose or by notifying support.
Complete deletion of the user account is only possible once there are no ongoing bookings and no outstanding, due claims remaining.
Termination or deletion of the user account does not automatically end ongoing bookings. Ongoing bookings must be properly ended, or clarified with support, before deletion.
Fees already accrued, or still to be billed, remain owed even after termination, suspension or deletion of the user account.
VeloGrid may temporarily suspend or permanently terminate a user account for good cause, in particular in the case of serious or repeated breaches of these Terms of Use, misuse, attempted manipulation, or repeated non-payment of legitimate claims.
Existing subscriptions are governed, as to term and cancellation, by the conditions displayed at the time they were concluded.
The processing and retention of personal data after termination of the user account is governed by VeloGrid's then-current Privacy Policy.
Information about the processing of personal data in connection with the use of the VeloGrid platform and the connected facilities can be found in VeloGrid's then-current Privacy Policy.
The Privacy Policy is available via the VeloGrid platform and VeloGrid's website.
VeloGrid may amend these Terms of Use where necessary due to statutory or regulatory changes, technical developments of the VeloGrid platform, changes to the range of services offered, or comparable objective reasons.
Material changes will be communicated to registered users before they take effect, in a suitable form, in particular via the VeloGrid platform or by e-mail.
For bookings already concluded, the conditions applicable at the time the booking was concluded generally continue to apply.
Changes apply to future bookings from the communicated effective date.
Where a change requires the user's express consent, VeloGrid will obtain this before the change takes effect.
The German version of these Terms of Use is legally binding.
In the event of discrepancies between translations and the German version, the German version prevails, to the extent permitted by law.
The contractual relationship between the user and VeloGrid regarding the use of the VeloGrid platform is governed by Swiss law, subject to mandatory statutory provisions, in particular mandatory consumer protection provisions.
For the usage relationship concerning a specific facility, additional or differing statutory provisions may apply due to the operator's registered seat, the facility's location, or mandatory statutory requirements.
The statutory places of jurisdiction apply to disputes.
Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
